Cases check after pathologist quits

Government lawyers are to decide whether to review all cases involving an under-fire pathologist who carried out tests on the body of a butcher found at the home of entertainer Michael Barrymore.

Dr Michael Heath has stopped working for the Home Office after being criticised at a disciplinary hearing.

He had resigned from the Home Office register of pathologists after being censured by a panel of experts investigating criticism of his work, a Home Office spokeswoman said.

The Attorney General's office would now decide whether all cases involving Dr Heath would be reviewed.

Dr Heath has been involved in hundreds of criminal inquiries during the past 15 years - including the investigation into the murders of Lin Russell, 45, and her daughter Megan, six, in Chillenden, Kent, in 1996.

His most high-profile in recent years was the inquiry into the death of Stuart Lubbock, whose body was in a swimming pool at Mr Barrymore's home near Harlow, Essex, in March 2001.

Dr Heath carried out post-mortem tests on the day Mr Lubbock died. A second examination was later completed by another pathologist. Mr Lubbock, 31, of Harlow, Essex, died after going to a party at Mr Barrymore's house near Harlow.

Doctors said Mr Lubbock had suffered severe internal injuries that suggested he had been sexually assaulted, and alcohol, Ecstasy and cocaine were found in his bloodstream.

A lengthy investigation was carried out by Essex Police but, although Mr Barrymore accepted an official caution for drugs offences, no-one was charged in relation to Mr Lubbock's death. A coroner recorded an open verdict in September 2002.

In April, police began a routine review of the case - but that has not resulted in any new developments. Dr Heath was unavailable for comment.
